These Terms of Service govern your use of the TravNomad platform and services. Please read them carefully before using our Service.

1. Acceptance of Terms

By accessing or using TravNomad ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

TravNomad is a software-as-a-service platform designed for travel advisors and agencies. The Service includes: - AI-powered trip itinerary generation - Travel proposal creation and publishing - Client trip portal management - Business management tools (pricing, CRM, analytics) - Related features as described on our website The Service is provided "as is" and we continuously improve and update features. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

3. Account Registration

To use TravNomad, you must create an account. You agree to: - Provide accurate and complete registration information - Maintain the security of your account credentials - Promptly update your information if it changes - Accept responsibility for all activity under your account - Notify us immediately of any unauthorized access You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payment

Free Tier: The Starter plan is available at no cost with limited features as described on our Pricing page. Paid Plans: Professional, Agency, and Enterprise plans require a paid subscription. By subscribing, you agree to pay the fees associated with your selected plan. Billing: Paid plans are billed monthly or annually, depending on your selection. Fees are charged at the beginning of each billing period. Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Price Changes: We may adjust pricing with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

5. Your Data and Content

Ownership: You retain full ownership of all data, content, and materials you create or upload to TravNomad, including trip itineraries, proposals, client information, and business data. License to Us: You grant TravNomad a limited license to host, store, and process your content solely for the purpose of providing and improving the Service. AI-Generated Content: Content generated by our AI features (itineraries, suggestions, descriptions) is created for your use. You are granted full rights to use, modify, and distribute AI-generated content for your business purposes. Responsibility: You are solely responsible for the accuracy and appropriateness of content you publish or share with clients through the platform.

6. Acceptable Use

You agree not to: - Use the Service for any unlawful purpose - Upload or transmit malicious code, viruses, or harmful content - Attempt to gain unauthorized access to any part of the Service - Interfere with or disrupt the Service or its infrastructure - Use automated tools (bots, scrapers) to access the Service without permission - Resell or redistribute the Service without authorization - Impersonate another person or entity - Use the Service to send spam or unsolicited communications - Violate the intellectual property rights of others We reserve the right to investigate and take appropriate action against violations, including account suspension or termination.

7. Intellectual Property

Our IP: TravNomad, its logos, designs, features, and underlying technology are owned by TravNomad and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, brand elements, or proprietary technology. Feedback: If you provide suggestions, ideas, or feedback about the Service, we may use them without obligation to you.

8. Third-Party Services

TravNomad integrates with third-party services (AI providers, payment processors, image sources, map services). Your use of these integrations may be subject to the third party's terms and policies. We are not responsible for the practices or availability of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: - The Service will be uninterrupted or error-free - AI-generated content will be accurate, complete, or suitable for any particular purpose - The Service will meet all your requirements Travel advisors should always verify AI-generated itineraries, pricing, and recommendations before presenting them to clients.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVNOMAD AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless TravNomad, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: - Your use of the Service - Your violation of these Terms - Content you create, upload, or share through the platform - Your interaction with your clients using the Service

12. Termination

Either party may terminate this agreement at any time: By You: Cancel your account through account settings or by contacting support. By Us: We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with reasonable notice. Upon termination, your right to use the Service ceases. We will retain your data for 30 days after termination, after which it will be permanently deleted unless legally required to retain it.

13. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the platform at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
